Let the truth be established in a court says
This matter should be allowed play out in the courts. Ben Roberts-Smith deserves the presumption of innocence until found guilty beyond reasonable doubt of the alleged offences.
Ben Roberts-Smith has already lost a defamation case from journalists alleging that he either directly killed unarmed and detained Afghanistan persons, or ordered subordinates to do the same. But those defamation proceedings were based on a lesser proof criteria of a “balance of probabilities” (a bit like a US civil case).
The current criminal case based upon the same allegations of detained, unarmed civilians being executed, must achieve a higher level of proof – beyond reasonable doubt – in order to establish guilt.
Such a “beyond reasonable doubt” proof will be difficult to achieve in the absence of credible eyewitness reports, forensic evidence, medical reports, or other evidence to substantiate the allegations.
But the possibility should not be discounted that the same person could on some occasions display great personal heroism, and on other occasions, undertake illegal actions.
If, hypothetically, William Calley Jr. had previously undertaken heroic actions for which he had been awarded the Medal of Honor, should Calley have subsequently been excused of the later murder of unarmed South Vietnamese civilians in the My Lai massacre, for which he was charged?
Many Australians would likely criticise the time taken to bring these allegations to trial (justice delayed is justice denied); the deleterious impact the allegations have had on the reputations and mental health of soldiers involved; and the lack of accountability for the chain of command, rather than just those actually accused of the crimes.
Many Australians are likely to want the matter legally resolved once and for all, sooner than later.
If it turns out that a decorated, and indisputably brave soldier, is also responsible for illegal killings, then so be it – he should face the consequences.
If, however, it turns out that the allegations of criminality can not be proven beyond reasonable doubt, it is unknown how Ben Roberts-Smith gets his reputation restored. He would become like OJ Simpson, with some people always considering him guilty, even if not proven to be so beyond reasonable doubt in a court of law.
This is a sad incident, for which there will be no winners, regardless of outcome.

I was just listening to the highest rating talkback radio station, 2gb, a fairly conservative station and they were discussing this issue and the presenter said the response, text messages, on this issue was off the charts. Plenty of outrage about this. This has been dragging forever. I think they said 17 years. Probably it might help one nations popularity surge. This Labor government are hopeless from my point of view, but, hey, they were voted in and as a strong believer in democracy, you get the government you deserve and voted for.hopefully Labor will be voted out next time around.
