Republicans in Congress Want to Punish the ICC

Even Joe Biden called the recent decision by the International Court of Justice to issue arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Israel’s former Defense Minister Yoav Gallant — for supposed “crimes against humanity” and “war crimes” — “outrageous.” And Republicans in Congress are even more furious. The Senate Majority Leader-elect, John Thune of South Dakota, denounced the ICC for issuing arrest warrants that he described as “outrageous, unlawful, and dangerous.” More on what the Republicans plan to do to punish the ICC can be found here: “Penalizing the criminal international court,” by Ruthie Blum, JNS, November 22, 2024:

Senate Majority Leader-elect John Thune (R-S.D.) on Thursday called the International Criminal Court’s issuing of arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant “outrageous, unlawful and dangerous.”

Thune then demanded that current Senate Majority Leader Chuck Schumer (D-N.Y.) “bring a bill to the floor sanctioning the ICC,” warning that “if he chooses not to act, the new Senate Republican majority next year will.”

The double threat—aimed simultaneously at Schumer and the kangaroo court at The Hague—was significant for two reasons.

First, Thune has good reason to finger-wag at his Democrat counterparts, thanks to their disturbing attitude towards Israel. Professing an “ironclad commitment” to the Jewish state’s “right to defend itself” while withholding crucial arms shipments to America’s key ally and only democracy in the Middle East has made them deserving of suspicion by the likes of Thune and the rest of the unflinchingly pro-Israel Republicans.

The fact that a whopping 19 Democrat senators voted this week to advance resolutions put forth by Sen. Bernie Sanders (I-Vt.) to block the transfer to Jerusalem of offensive weaponry necessary for its self-defense is a case in point.

Though Schumer—like President Joe Biden and other members of his party who have been critical of Israel’s prosecution of the wars in Gaza and Lebanon—opposed those resolutions, they’ve been openly hostile to the Netanyahu government since its inception; so much so that they’ve never concealed their desire for it to be toppled.

Second, there are concrete steps that the powers that be in D.C. can take against the ICC, such as the Illegitimate Court Counteraction Act, passed in May by the U.S. House of Representatives. House Speaker Mike Johnson on Friday reiterated his demand that the Senate vote on it “immediately.”

If the current Senate, where the Democrats still have a majority until January 3, fails to pass the Illegitimate Court Counteraction (get it — ICC) Act, then the Republican-controlled Senate will in the first week of January pass it. No later than the beginning of January 2025, the International Court Counteraction Act will become law. This imposes sanctions, including blocking the assets of International Criminal Court (ICC) employees and associates, if the ICC investigates or pursues charges against certain individuals. Among those who will be pursued is Kareem Khan, the ICC’s prosecutor, who also happens right now to be under investigation for sexual misconduct, which might be enough to lead to his discharge, and replacement by someone less hellbent on punishing Israel.

In a Trump administration, every effort will be made by the United States to undermine the authority of the ICC. It is an unelected and unrepresentative body, that presumes to pass judgement on, and then to attempt to arrest, individuals from countries that are not subject to the Court’s jurisdiction. Right now, at least one country, Hungary, has shown its contempt for the ICC’s latest decision by inviting Prime Minister Netanyahu for a visit. Perhaps now would be a good time for President-elect Trump to do the same, and invite Netanyahu as the first foreign leader to visit him in his second term. It’s a good way to tell the ICC what the new administration thinks of it.

  1. Here’s a thought: Charge the ICC with criminal negligence and malicious prosecution and issue arrest warrants for the judges should they ever come to America.

  7. First the Republican in Congress should do anything that are able to do the in some way inflect a punishment for International Criminal Court for its absurd and outright false charges “crimes against humanity’ against the Prime minister of the State of Israel

    If the ICC was a really interested in have warrants out for war criminals go after the chief on Hamas for those attempts at genocide against the Jewish people which stated on October 7, 2023 . Likewise, the ICC should go after those despots of Iran for supplying Hamas with deadly weapons and encouraging Hamas to launch a murderous jihad attack in Israel which in did on 10/7/23.

    Second, that leftist institution that is the ICC has been long thoroughly corrupted and infiltrated by the insidious Red/Green alliance. Therefore, it would naturally make unfounded and unproven false accusations of “war crimes” against Benjamin Netanyahu.

    Third, those charge of “war crimes” against Benjamin Netanyahu by the International Criminal Court is absurd libelous slanderous and false. For it’s those jihadists of Hamas who committed action of attempted genocide against the Jewish people.

    For it was Hamas that stated that current war in the Middle East by murderously invading Israel, on October 7,th , and now has its jihadists hide their terror and weapon centers among civilians ,including children in Gaza and then have the gall to blame the Israel Defense Force when civilians are killed.

    For it was Hamas using its jihadists stooges then attempted to commit genocide against the Jewish people and the jihadists of Hamas even went further in heinous evil by kidnapping many Israel’s and raping many Jewish females .

    Those Hamas jihadists are so cruel and vicious that they even took Jewish infants and burned them to death while they were still alive.

    In spite of all those facts, some despicable people want to have acquittal for Hamas from all is wicked jihad terrorism and release its jihadists from the monstrous Islamic evil that they have so vicious committed and are very guilty of, and yet condemn Israel for striking back and Hamas in self- defense. This is absurd and wrong. Very absurd and wrong.

    To add to this libelous and slanderous of false charges of genocide are made against Israel about it heads of government and the IDF.

    Such charges are as absurd as they are also wrong. Those changes are very absurd.
