India: Death sentence commuted of Muslim who raped and murdered six-year-old girl because he prays regularly

Sheikh Asif Ali’s prayers must mean he is repentant, right? Right?

The Qur’an teaches that Infidel women can be lawfully taken for sexual use (cf. its allowance for a man to take “captives of the right hand,” 4:3, 4:24, 23:1-6, 33:50, 70:30).

On 20th June, the Orissa High Court commuted the death sentence of Sheikh Asif Ali to life imprisonment from death sentence. Asif is convicted of rape and murder of a six-year-old girl. The court noted in the judgment that Asif was consistently offering Namaz several times a day and he was ready to accept the punishment as “he has surrendered before God”. The court took his readiness to accept his punishment as a sign of remorse and potential to reform.

The Bench comprising of Justice SK Sahoo and Justice RK Pattnaik stated, “The punishment should not be disproportionately great is a corollary and it is dictated by the same principle that does not allow punishment of the innocent, for any punishment over what is deserved for the criminal conduct is punishment without guilt. There is no cogent evidence that the appellant is beyond reform and rehabilitation,” while commuting the death sentence to life imprisonment.

The incident

On 21st August 2014, the young victim and her minor cousin went to buy chocolates at around 2 PM. By 3 PM the girl did not return which worried her family. They called the villagers and initiated a search for her. The 6-year-old was found naked and unconscious in a narrow part of Sheikh Khairuddin’s house. She was rushed to a primary health care centre from where she was referred to SCB Medical College and Hospital in Cuttack. While she was being taken to the hospital, the victim succumbed to her injuries.

The victim’s cousin disclosed later that Sheikh Asif Ali and Sheikh Akil Ali had forcibly taken her away. A complaint in the matter was filed by the victim’s family leading to a case being registered against the accused under Sections 302, 376-D, and 376-A of the Indian Penal Code (IPC) and Section 6 of the Protection of Children from Sexual Offences (POCSO) Act.

During the investigation and based on the postmortem report of the deceased, it was found that the accused in the case gagged the mouth of the deceased and lifted her in arms to take her away. They raped the 6-year-old child and then strangulated her to death….

  1. One of India’s major problems is that their judiciary is an elite club that intellectually (for want of a better term) fuels itself from their Ivy League connections. So for instance, while there is absolutely no support for gay marriage in India, be it from the public nor politicians, it has been members of the Indian Supreme Court who have been calling on the government to come out w/ a policy on that, despite no public support for it

    To make things worse, unlike the US where judges are either appointed by elected officials or elected themselves (depending on state), in India, they are just self-selected by something called a “collegium”. where all the judges keep nominating each other’s kids, making it a completely closed club. It’s similar to the issue Israel had several months ago when they announced some judicial reforms. India hasn’t yet figured out how to solve this problem. It’s better they do, before people start going full vigilante

  2. In Western countries, a lot of serial killers claim to “find religion” (especially Christianity, including born-again Protestantism), and start to conspicuously pray often, to earn points with the judicial and correctional system…so what?

    • Disgustingly, I have a close relative who did just this in prison–he started to attend Bible study to get more benefits or an early release. He dropped it immediately after his first annual review when it was obvious that this didn’t offset any of his bad behavior.

      But this story is worse yet–one might reasonably assume that *some* prisoners who turn to Christianity are genuinely trying to reform, despite some who fake it for effect.

      But prisoners turning to Islam–or just exhibiting their already existing adherrence to it–are unlikely to regret their brutalizing Infidels, including children. Just the opposite, really.

  4. It’s more like he believes he will go instantly to that fake and putrid ‘paradise’ where he will be with the fake and putrid ‘prophet’ who is supposedly staying stinking drunk and raping young boys, young girls and Mary, the mother of Jesus.

    If he really had “remorse” and accepted that what he did was really evil, he wouldn’t be calling on his false god; he would be rejecting that demon and the fake prophet with the demands that he rape and murder his way through life.

    The “judges” who spared his filthy existence, are fools. They need to find out more about mozlums and their total lack of remorse and change.
    At least the ghoul is delayed in his wish to go rape other children as he believes he will be doing.

    • I find it odd that he didn’t want to be executed. If his religion allows him to rape little girls and murder them, he should go to Paradise for ridding the world of one more infidel.
      Or perhaps he doesn’t believe quite so much as he says?

  5. Sorry folks praying 6x a day link a trained chimp responding to a trigger has no bearing on whether this a$$hole should die. Any judge letting him off from the death penalty should join him on death row. As should anyone citing grounds of potential civil unrest. As for riots theybare dealt with by declaring it a riot and shooting rioters. That way the riot stops and the shot ones don’t riot again. Sorry India you need to grow a pair.

  6. The fact that he is studying and following his Holy Book is every reason for him NOT to be spared. Reading that was probably the reason for abusing a young girl, following a certain example ?

    “Oh, Allah, send me some more kafir girls that I can rape.”

  8. Look at the problems India has with Islam .. and yet India does something about it now and again
    Then think about the problems we are letting ourselves in for because we won’t do a thing other than encourage it and make excuses for it !

    • Every country’s people think that other countries are tougher on islam than they are. For instance, a lot of Indians who are disgusted at the pandering of muslims think that Western, particularly European, countries are tougher on islam: their favorite example being France for President Macron denouncing the beheading of a Catholic priest some years ago. Yet, France has been doing nothing about muslim immigration into that country, which is why Macron seems to have his political back to the wall. To be fair, neither has India done anything about Bangladeshi & Rohingyas in their country

      Truth be told, all countries are somewhat wanting one way or the other when it comes to the treatment of islam. Only countries that have impressed me are Burma and Sri Lanka

  10. In many cases, riots happen right after Friday prayer in mosques, so muslims come out of mosque to become more hostile and evil than duing their daily life. Also, after making pilgrimage to Mekah, muslims often become more militant and hateful toward non muslims. Another observation, a lot of people become killers after converted to Islam. That shows Islam is an evil religion.

    For comparison, people who go to church, usually are reminded not to sin, so they may become better people for a moment after leaving church, very much the opposite of muslims.

    • Exactly–note that Sundays in nations with large Christian populations are not known for violence–just the opposite, as a rule.

      But Muslims hopped up on violent Kutbahs at the Mosque on Fridays often go on rampages against Infidels.

    Anyhow, in Islam the all knowing and all merciful Allah has preordained everything and logically the only sin a Muslim can commit is to act against the will of Allah!

    So if Allah’s will is to rape and kill minors who are we to say that it’s wrong? Allah knows best!

    It is probably a safe bet that his prayers are prayers of thanksgiving

    • Even then, Ralph, you have to *want* to commit the crime. How many Infidels *want* to rape 6-year-old children? Very few, I would guess, whether it is likely that they would be caught or not.

      This is not quite the same as idly wishing you could walk off with a new IPhone or a big screen TV without consequences…

  14. Does the victims six year old girl get her life back, was he praying for her? I think NOT, he was praying for his sorry ass, and some idiot judge fell for it.

  15. I hope the same doesn’t happen to the judge’s family. If it happens would the judge give the same judgment citing he is praying sincerely? This scum deserves nothing but death along with that psychopath.
