Biden Sues Alabama, Claims Ban on Transgender Child Abuse Violates 14th Amendment

The Fourteenth Amendment states that, “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

At no point in time does it state that states are not allowed to ban child abuse simply because a particular group tends to practice that abuse. For example, states can be raping 7-year-olds even though Mohammed married a 7-year-old girl. 

Biden and his hack running the DOJ disagree.

The DOJ has sued Alabama over Senate Bill (S.B.) 184 or the Vulnerable Child Compassion and Protection Act. 

The filing is filled with woke gibberish that makes lots of assertions without ever meeting a basic legal standard.

For example, “This lawsuit challenges a state statute that denies necessary medical care to children based solely on who they are.”

The assertion that children being subjected to puberty blockers or other abuses are “who they are” is completely unproven. There is no factual basis for asserting that the children being subjected to these “treatments” are any different than any other children.

The law bans all children from being subjected to such medical experiments, based not on their identity, but on the procedures.

“All people, including transgender youth, deserve to be treated with dignity and respect. And the Fourteenth Amendment demands that Alabama not “deny to any person within its jurisdiction the equal protection of the laws.” U.S. Const. amend. XIV.”

All children deserve to be protected. Banning experimental procedures on children that will damage them irreversibly doesn’t diminish dignity and respect. Nor does it deprive anyone of equal protection. 

It is a form of protection.

The core of the argument is that medical procedures can be used to help children who suffer from physical defects, but not for “transgender” procedures.

S.B. 184 thus allows a minor to receive certain medical procedures or treatment only if they will be used to affirm the sex that the minor was assigned at birth. 6. The law discriminates against transgender minors by unjustifiably denying them access to certain forms of medically necessary care. 7. While criminalizing certain forms of medically necessary gender affirming care for transgender minors, S.B. 184 permits all other minors to access the same procedures and treatments. 

Biden’s DOJ keeps saying “medically necessary”, but it really means “psychologically necessary” which is not the same thing.

Medical procedures are concerned with repairing physical defects. Puberty blockers for psychological reasons based on a destructive current trend is not medically necessary. 

That’s the equivalent of arguing that if patients who need to have a leg amputated after suffering a car accident can get it done, then it violates the Fourteenth Amendment not to allow people with body integrity identity disorder (BIID) which is a mental problem in which people want their limbs removed to be able to do it too.

Obviously cutting off people’s body parts due to their delusions is never an answer. And, secondly, this kind of thing should never be inflicted on children.

Biden is fighting to engage in child abuse.

The Democrats believe in abortion up to the 9 month and even in letting “aborted” babies born alive to die by withholding medical treatment why is anyone surprised they also believe in castrating children because their deranged patents ,or teachers or caretakers believe they were born the “wrong sex” or misgendered at birth? A seven year old cannot vote, buy beer or smoke or get a tattoo no matter what his or her patents says the child wants ,but the can push for castration on a seven year because of his or her wants or needs?

    • Agree, wpm. If individuals want to engage in this after they become adults, this should be their right. But children having this done to them by adults is obviously potentially coercive. And no child can fully understand the ramifications of such steps.

  2. The government “medically approved ” suicide of the elderly sick or even healthy depressed people will be next on the agenda in the next 10 years you can bank on that.

    • This has already come up–and is chilling. In the case of people in pain with terminal illnesses who want to pass away with more dignity or less pain it may be understandable; but it is obviously a slippery slope where those who are disabled or too much trouble for their families or the state can be pressured into suicide.

  3. It is medical MALPRACTICE to operate on or remove a healthy organ or administer drugs to a healthy young person to change the body’s characteristics when there is no medical condition that requires it.

    Pediatricians know this, but they are afraid to disagree in public with WOKE mob.

  4. A mom in Florida is suing the school where her child attended and was pressured to be a figment of the imaginations of four very rich homosexuals, a.k.a. “trans”. According to the mom, her daughter saw a lot of her friends become “trans” and said she was confused; so the school personnel proceeded, behind closed doors and without the knowledge or consent of the mom, made her daughter the figment of the imagination of the four rich perverts, a.k.a. “trans.”

    According to the news report, parents in several other states are also suing the schools their children attend and where their children have been “transitioned” in secret. The Florida mom and her attorney say that all of the schools are using the exact same wording to manipulate the kids.

    Alabama needs to fight back. Just as Florida is fighting these rich perverts who want to own and manipulate the minds and bodies of the kids. There is no Law that protects such perversion.

  5. No one is ‘assigned’ a sex at birth. It is what they are.
    Just as minors can’t buy alcohol or cigarettes ( which doesn’t mean they can’t get their hands on them), maybe laws can be written to deny any ‘transgender’ procedure or drug to someone under the age of eighteen.

    By law, minors are unable to give consent to medical treatments or procedures. The consent of a parent or guardian is required, except in a life-threatening emergency.
    Gender cannot be ‘affirmed’. A person’s sex (the word gender is constantly being misused) can neither be affirmed nor denied. It was determined at the moment of fertilization. It is what it is.

    Well, this is just ridiculous. This Amendment was about granting citizenship to formerly enslaved people. The idea that not enabling child abuse violates this Amendment is just grotesque.

  12. How about we remove Old Joe under the 25th Amendment for being senile? Being senile means he is no longer fit for President. The only problem with that is Cackling Kamala would be even worse.

    • According to the Law, the dems would have to remove biden using the 25th. The repubs can’t, just like pelosi couldn’t have Mr. Trump removed.

  13. How is it that interrupting a child’s normal development with medical intervention is somehow medically necessary, but dental health procedures that restore or maintain a person’s ability to eat a healthy diet and not suffer from systemic effects of inflammation are, “cosmetic”?

    If little Timmy feels like a girl today, time will work it out one way or the other, and he can work out the kinks of his life medically as an adult. Nobody will stop him.

    Poor dental health is a huge problem in this country. It drives heart disease and dementia up, it’s hard for younger people with bad teeth to get decent jobs. It has a huge impact on people’s lives.

    Since when is it imperative to give kids what they want according to whim driven by fads? Why is this some kind of pressing emergency over bathrooms to use? Kids have parents biological, foster, or adoptive in this country. Lots of other countries have orphanages. How about let’s let the parents do their job without being undermined and stop fiddling over nonsense and deal with the real practical problems (instead of creating new problems for ourselves).

    I think this trans mania is meant to distract us from real problems (and it’s going to ruin women’s sports). I’ve known 6 trans women, 2 of them pretty well. The ones I’ve known have been smugly abusive to biological women. I don’t know about trans men, but the trans women I’ve known are on the front lines of misogyny, hiding behind protected status. Sickening.

  14. Pure child abuse by an adult with authority. And that should include parents who cause a bodily injury or un-necessary surgery to a minor.
