On Saturday, the Fifth Circuit Court of Appeals struck at least a temporary blow for individual freedom and common sense, temporarily suspending Biden’s handlers’ tyrannical and absurd vaccine mandate in light of “grave statutory and constitutional issues.”
The mandate forces companies with more than 100 employees to require vaccinations or weekly COVID-19 tests. This requirement, which makes less sense with each passing day as new evidence comes to light that the vaccines just don’t work, was challenged by, among others, a Louisiana businessman whose name is actually Brandon: Brandon Trosclair.
According to Pelican Post News, Brandon Trosclair “employs nearly 500 people across 15 grocery stores in Louisiana and Mississippi. Under the new rule, Trosclair would be forced to fire any employees who decline the COVID vaccine – many of whom have worked tirelessly since the pandemic’s start.” Consequently, “with help from the national law firm Liberty Justice Center and the Louisiana-based Pelican Institute for Public Policy,” Trosclair and some other lovers of freedom filed a petition with the U.S. Circuit Court of Appeals, asking for a stay of the mandate.
Daniel Suhr, managing attorney at the Liberty Justice Center, declared: “The Biden Administration’s illegal vaccine mandate for private companies represents the most egregious government overreach in our generation. No matter how you feel about the COVID vaccine, every American should be outraged. Apparently, the Biden Administration’s COVID strategy is this: circumvent Congress, ignore the Constitution, then threaten and bully millions of Americans to get vaccinated against their will. It’s an assault on the U.S. Constitution, which the President has sworn to uphold.” Yeah, but he’s probably forgotten he did that.
Sarah Harbison, General Counsel at the Pelican Institute for Public Policy, added: “Not only is this mandate a blatant overreach by the federal government, it also has a real impact on Americans who are looking for work and business owners who are struggling to keep their doors open. The Biden Administration’s mandate will put up a new barrier to work that hurts people’s ability to get a job and provide for their families.”
Indeed. These are commonsense observations, and against all odds, they prevailed in an American court, at least for now: Trosclair’s petition has been granted.
“Before the court is the petitioners’ emergency motion to stay enforcement of the Occupational Safety and Health Administration’s Nov. 5 2021 Emergency Temporary Standard (the ‘Mandate’), pending expedited judicial review. Because the petitions give cause to believe there are grave statutory and constitutional issues with the Mandate, the Mandate is hereby STAYED pending further action by this court,” the 5th Circuit panel said in a statement.

One of the arguments against osha being able to do this: they are saying it comes under their authority due to an “emergency”…after nearly two years of the “pandemic” has been going on.
In what kind of situation can a two-year wait constitute an “emergency”?
What is sad, not all Americans have been “outraged” by this mandate to force the jab on everyone. Many are all for the government forcing us to give up our “right” to decide some things for ourselves.

About two-dozen states so far have filed lawsuits against Biden’s vaccine mandates. The Daily Wire, the news outlet fronted by Ben Shapiro, as well as the Republican National Committee also filed legal actions against the requirement, arguing that it violates the Constitution.

That is a true statement.
People who have been vaccinated (or have acquired natural immunity) can still get Covid – and spread it. Whether or not they can spread Covid as easily as a vaccinated person – or one with acquired immunity – is still inconclusive. But several studies suggest that people who are vaccinated may spread Covid just as easily than those who are unvaccinated.
Yet there are still mandates in order to protect – of all things – the “vaccinated from the unvaccinated”.
This is nonsensical.

It isn’t just that, but how come those in Congress, the WH staff, and certain others, including illegals and mozlums recently here with all kinds of diseases, don’t have to get the shots?
Since the ones getting the shots can still “catch and release” the virus, then why is there such a push to force it on those who have objections…pro-life reasons, GBS issues, objections to what is in the vials…steel, chemo drugs…, and those who just don’t want to be forced to comply with something they don’t believe they need or that has a high failure rate along with serious side effects?

Great question.
A person who gets vaccinated can still get – and spread – Covid but has “good” personal protection against a very severe case. From a public health standpoint, it decreases the burden on the intensive care units, etc. But it does not protect others.
If a person decides to not get vaccinated – for whatever reason – they are not putting other people (regardless of their vaccination status) at risk according to the most recent studies.
Clearly, there is a significant political component to the CDC guidelines and government mandates.

If we are not putting others at risk, and we use the two vitamins and the mineral that helps protect a person from first contracting the virus, and if caught, helps to mitigate the severity, then there is no reason other than political to push it.
They said if they got 70% to take it, that would be good enough and now they say they have that number. Yet, now that’s not good enough.
My guess is that those who would catch it, have caught it by now and either died or got over it.

If you look at the VARES report the numbers of deaths and serious side effects are staggering.
What a terrible price to pay, Here in Canada we are reminded every of the “new Cases” but NEVER hear of the deaths from the injections.

That’s why the Covid vaccine should be carefully targeted to those individuals where the benefit of the vaccine outweighs its risks.
For example, teenagers should not receive the vaccine unless they have very significant comorbidities (e.g. severe metabolic syndrome) that would put them at a very high risk for a bad result from a Covid infection.
And anyone with acquired immunity from a previous Covid infection – and robust antibody titers – should not receive the vaccine.

Thank you James, there are many doctors in Canada who have lost their licence to practice for saying the same thing.
Dr. David Sion, a cosmetic surgeon, who has operated on and saved many lives of people I know, was fired for not agreeing to take the shot. I am saddened by the divisions I am seeing and the numbers of people I know who have shunned their loved one for refusing to take the shot.
I will always rely on God.

While this story is hilarious, I fear that in SCOTUS, the mandates will prevail, given that Kavanaugh and Amy Coney Barrett have already flipped and become totalitarians. The Federalist Society did an inadequate job in screening them before recommending them to President Trump: these 2 are a disgrace! I’m now regretting that the search and destroy mission against Kavanaugh didn’t succeed
