Incisive Analysis by Phares of the Fake Fatwa

Walid Phares skewers the Phony Phatwa in the Washington Times, with thanks to Andrew Bostom:

2. The fatwa states that "Islam strictly condemns religious extremism and the use of violence against innocent lives." This is another important statement, but it is too general to use in making inroads in the war of ideas against the terrorists. For the question is: Who determines what is an innocent life? How can this statement lead to a specific condemnation of the killing of innocent people in Iraq's Sunni Triangle, Moscow, and Sudan at the hands of jihadists who specifically state in their own fatwas that there are no innocent lives when a jihad is waged? The American fatwa could have been specifically geared to defeat the jihadist ideology.

3. It states that: "There is no justification in Islam for extremism or terrorism. Targeting civilians' lives and property through suicide bombings or any other method of attack is haram -- or forbidden -- and those who commit these barbaric acts are criminals, not 'martyrs.' " Again, it would have been more efficient to respond directly to the jihadists who quote from the Koran and other texts and sources. For example there was no such thing as explosives in the 7th century, yet al Qaeda, its allies and even Sheik Yussuf al-Qardawi on al Jazeera have justified the use of suicide bombing, and called it permissible in certain conditions. Sheik al-Qardawi went as far as linking today's suicide bombing to what he called "inghimass" (to throw oneself against the enemy). According to him, this has been permitted by religious teaching since the early days of Islam. A fatwa issued in the West or in the United States must respond to Sheik al-Qardawi and the jihadists theologically, and not state globally what international law and 52 Muslim countries subscribe to already.

4) The text of the fatwa says: "The Qur'an, Islam's revealed text, states: 'Whoever kills a person [unjustly]... it is as though he has killed all mankind. And whoever saves a life, it is as though he had saved all mankind.' " (Koran, 5:32). This powerful quote has to supercede all other references al Qaeda uses with regard to the kuffar (infidels) from any source. For the jihadist terrorists would quote the same sentence and simply state that the persons they are killing are "justly" killed. Their ideologues have already responded to this reference by saying that whoever kills outside the injunction of the right jihad is acting as if killing all mankind. The same logic applies to all other quotations in the fatwa: a need for theological response to the jihadists in addition to general quotes...

Concerning:

'Whoever kills a person [unjustly]... it is as though he has killed all mankind. And whoever saves a life, it is as though he had saved all mankind.'

Everyone should be informed that these often-quoted words are accompanied by the mitigating words 'except for those who cause mischeif in the land' ... which in practice can mean anyone who opposes Islam. Hence, null and void.

"We ordained for the Children of Israel that if any one slew a person – unless it be for murder or for spreading mischief in the land – it would be as if he slew the whole people: and if any one saved a life, it would be as if he saved the life of the whole people. (5:32)"

Sura 5:31-5:33 is a warning to the Jews firstly, but eventually encompasses all non Muslims.

Sura 5:31 sounds truly humanitarian when taken by itself. It is one Sura which Muslims like to quote completely out of context.

Maybe as an infidel I don't understand what a "fatwa" is in its complete form.

So correct me if I'm wrong when I say, who the hell is anyone to issue a "fatwa"???What ever happened to the separation of Church and State? What ever happened to the "natural" course of justice??? Why is it that a religious group can take it upon themselves to issue decrees, that are above the natural course of justice??? Especially where life and death are involved??

Journalists, politicians, and Muslims who encourage and enguage in "Fatwa's" show that they have no respect for our laws/court system of justice.

Fatwa issuing Muslims are NOT the law. As far as I last heard, the Law, was my duly elected parliment, and the Judges that these fat cats appoint. Not some mad mulla Fatwa issuing Muslim? Even if the "fatwa" is "against terror" (whatever that is, I always got the impression that Fatwa's, historically speaking, were on people, not ideas) who on earth gave them the legal right to do such a thing?

PS Did anyone see "John Safran v's God" where John gets a Fatwa issued on Rove - his media rival?? Talk about a crack up!!

In the name of Allah

All praise is due to God alone. May peace and blessings be upon our prophet. To proceed;

I can sum up your agenda very easily:

"They intend to put out the light of Allah (i.e. the religion of Islam, this Quran, and Prophet Muhammad SAW) with their mouths. But Allah will complete His light even though the disbelievers hate (it)."
(Qur'an 61:8)

"And they will never cease fighting you until they turn you back from your religion (Islamic Monotheism) if they can."
(Qur'an 2:21)

The fighting here is with the ideological propoganda as explained in the first qoute, as well as physical.

"Never will the Jews nor the Christians be pleased with you till you follow their religion. Say: "Verily, the Guidance of Allah (i.e. Islamic Monotheism) that is the (only) Guidance."
(Qur'an 2:120)

My evidence of all of this is that you have some sincere muslim scholars in the U.S. trying to show their good faith by putting out there the view and opinion of the majority of Muslims who are your neighbors...but instead of accepting their outreach you try to find ways to attack.

Then, after they made a step towards the direction you asked them to take you turn around and rip it apart...and then you again call out, where are the "moderate muslims" why won't muslims stand up , why won't they speak out?!?

Never will you be satisfied with Muslims until they believe like you do, accept this democratic republic as deity and give up on God's laws.

May We all be guided.
